1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of the website at https://trinityconinc.com and the construction services provided by Trinity Construction Co, Inc., a Wisconsin corporation doing business as Trinity Construction ("Trinity Construction," "we," "us," or "our"). By using our website, requesting an estimate, signing a service agreement, or opting in to receive SMS messages from us, you agree to be bound by these Terms.
2. Website Usage
You may use our website for lawful purposes only. You agree not to use the website in any way that could damage, disable, overburden, or impair our services, or interfere with any other party's use of the website. All content on the website, including text, images, logos, and graphics, is the property of Trinity Construction or its licensors and is protected by U.S. and international intellectual-property laws.
3. Services
Trinity Construction provides residential and commercial concrete contracting services in Southeastern Wisconsin, including but not limited to driveways, sidewalks, ADA-compliant flatwork, parking lots, curb and gutter, industrial flooring, and excavation/site preparation. Specific scope, materials, schedule, and pricing are set out in the written service agreement we provide to each customer before work begins.
4. Pricing and Payment
Estimates are provided free of charge and are valid for the period stated on the estimate. Final pricing is set by the signed service agreement. Payment terms (deposit, progress draws, and final payment) are described in the service agreement. Late payments may accrue interest at the rate stated in the agreement or, if not stated, the maximum rate permitted by Wisconsin law.
5. Refund Policy
Concrete construction services are custom work performed on the customer's property and are generally non-refundable once the work has been performed. Any deposit or refund terms are governed by the signed service agreement. Workmanship issues should be reported promptly so we can investigate and remediate covered defects under warranty.
6. Ownership and Deliverables
On full payment, the physical concrete deliverables (e.g., the finished driveway, sidewalk, or pad) become the property of the customer as installed on the customer's real property. Trinity Construction retains ownership of all designs, drawings, photographs, brand assets, and other intellectual property used in delivering the service.
7. Hosting, Domain, and Maintenance
The Trinity Construction website is hosted and maintained on infrastructure operated by our service providers. Any work, communications, or data associated with the website are subject to those providers' service availability and security practices.
8. SMS and Text Message Terms
Consent to Receive Text Messages
By providing your mobile phone number and opting in to receive text messages from Trinity Construction, you consent to receive SMS or MMS messages from Trinity Construction (delivered on our behalf by GX Web Studio, our service provider) related to your project, including appointment confirmations, reminders, service updates, and a post-service review request.
Message Frequency and Rates
Message frequency varies based on your project and the services you use, typically 1 to 4 messages per service interaction. Standard message and data rates may apply depending on your mobile carrier and plan.
Opt-Out
You may opt out of receiving text messages at any time by replying STOP to any message you receive from us. Opt-outs are processed immediately.

No Mobile Information Sharing
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with third parties.
Carriers
Text messaging services are provided on supported carriers. Carriers are not liable for delayed or undelivered messages.
9. Limitation of Liability
To the fullest extent permitted by law, Trinity Construction's total liability for any claim arising out of or relating to these Terms or the services we provide will not exceed the amount actually paid by the customer for the specific services giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits or business interruption, arising out of or related to these Terms or our services.
10. Indemnification
You agree to defend, indemnify, and hold harmless Trinity Construction and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your breach of these Terms, your misuse of the website, or your violation of any applicable law.
11. Confidentiality
Each party agrees to protect the other party's confidential information with at least the same degree of care it uses to protect its own confidential information, and not to disclose it to third parties except as necessary to perform the services or as required by law.
12. Termination
Either party may terminate a service agreement as provided in that agreement. Trinity Construction may suspend or terminate your access to the website or our services if you violate these Terms.
13. Dispute Resolution
The parties will attempt to resolve any dispute arising under these Terms through good-faith negotiation. If a dispute cannot be resolved through negotiation, it will be resolved by the state or federal courts located in Waukesha County, Wisconsin, and each party consents to the exclusive jurisdiction of those courts.
14. Governing Law
These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws rules.
